Munich District Court I rejected Stiftung Warentest’s appeal today against the preliminary injunction obtained by Ritter Sport. Symrise welcomes this decision. Ritter Sport and Symrise have proven the naturalness of the flavor used. Ritter Sport labeled its Voll-Nuss product correctly.
The court holds the view that Ritter Sport and Symrise have credibly demonstrated that the piperonal flavor used was of natural origin and derived exclusively by natural means. Stiftung Warentest therefore remains prohibited from labeling piperonal as chemically manufactured and questioning the marketability of Ritter Sport Voll-Nuss.
