The Higher Regional Court Munich has rejected Stiftung Warentestʼs appeal against the preliminary injunction issued by the Munich District Court. With this decision, Stiftung Warentest remains to be prohibited from claiming that the flavoring compound piperonal contained in “Ritter Sport Voll-Nuss” chocolate has been produced chemically. Symrise welcomes this decision and considers it as a confirmation of the reliability and quality of its products.

With the decision from September 9, 2014, the Higher Regional Court Munich obtains the preliminary injunction against Stiftung Warentest, which was issued in January by the Munich District Court.

Symrise has assured right from the beginning that the natural flavor supplied for “Ritter Sport Voll-Nuss” as well as the therein contained natural flavoring compound piperonal met all requirements of the EC European Regulation on Flavorings.

Furthermore, the responsible food safety authorities did not raise any objections with regard to the declaration after a thorough examination.

For the proceedings, Symrise disclosed a comprehensive set of documents to the Higher Regional Court Munich concerning the natural occurrence of piperonal in different raw plant materials and detailed information on its natural extraction.

Symrise complies as a matter of principle and in all aspects with all legal provisions – especially the EC European Regulation on Flavorings – to the fullest extent. The Company will also continue to adhere to this standard in the future.
